General Information on the Personal Data Protection Law

The Law on the Protection of Personal Data No. 6698 (hereinafter referred to as “KVKK”) was adopted on March 24, 2016, and published in the Official Gazette No. 29677 dated April 7, 2016. Some provisions of the KVKK entered into force on the date of publication, while others took effect on October 7, 2016.

Information as Data Controller

In accordance with the KVKK No. 6698, as the Data Controller, your personal data will be recorded, stored, updated, disclosed/transferred to third parties where permitted by law, classified, and processed in the ways stipulated in the KVKK, within the framework set out on this page.

Processing of Personal Data

Pursuant to KVKK No. 6698, personal data shared with our Company may be obtained wholly or partially by automated means or non-automated means as part of any data recording system, and may be processed by recording, storing, modifying, reorganizing, or subjecting to any operation performed on data. Any operation carried out on data within the scope of KVKK is deemed as “processing of personal data.”

Purposes and Legal Grounds for Processing Personal Data

The personal data you share may be processed for the following purposes:

  • To perform the requirements of the services we provide to our customers in accordance with contractual and technological obligations, and to improve our products and services;

  • To record identity, address, and other required information in order to identify the transaction owner within the scope of the Law No. 6563 on the Regulation of Electronic Commerce, the Law No. 6502 on the Protection of Consumers, and the related secondary legislation;

  • To prepare all records and documents, whether electronic or in paper form, that will serve as the basis of transactions in the fields of banking and electronic payments; to comply with information retention, reporting, and disclosure obligations prescribed by legislation and other authorities;

  • To provide information to public prosecutors, courts, and relevant public officials when requested and required by legislation regarding matters related to public security and legal disputes.

Your personal data will be processed in compliance with the KVKK and related secondary regulations.

Transfer of Personal Data to Third Parties

For the purposes listed above, the personal data you share with our Company may be transferred to persons/institutions such as our e-commerce infrastructure provider Ticimax Bilişim Teknolojileri A.Ş., suppliers, cargo companies, business partners, program partners with whom we cooperate, domestic and/or international organizations, and other third parties acting as Data Processors.

Methods of Collecting Personal Data

Your personal data may be collected through:

  • Forms on our Company’s website and mobile applications, including details such as name, surname, ID number, address, phone number, work or personal email, login preferences, IP records, cookies collected by browsers, browsing duration and details, and location data;

  • Our sales and marketing department employees, branches, suppliers, sales channels, paper forms, business cards, digital marketing, and call center channels, verbally, in writing, or electronically;

  • Persons sharing personal data for purposes such as establishing a business relationship with our Company, job applications, or proposals, through CVs, business cards, proposals, and similar means, in physical or virtual environments, face-to-face or remotely, verbally, in writing, or electronically;

  • Indirectly through different channels, including websites, blogs, competitions, surveys, games, campaigns, micro-websites, social media, e-newsletter interactions, public databases, and publicly shared profiles/data on social media platforms.

Personal Data Obtained Before KVKK

Personal data lawfully obtained before April 7, 2016 (the effective date of KVKK), such as membership, electronic communication permission, product/service purchases, and other lawful means, are also processed and retained under the terms and conditions set forth in this document.

Transfer of Personal Data Abroad

Personal data collected through the above methods may be processed in Turkey or abroad, and may be transferred abroad to service providers located in countries accredited by the Personal Data Protection Board as providing adequate protection, provided it remains within the scope of KVKK and in line with contractual purposes.

Storage and Protection of Personal Data

Your personal data will be kept confidential in our Company’s databases and systems as per Article 12 of the KVKK, and will not be shared with third parties except for legal obligations and regulations stated in this document. Our Company is obliged to take necessary software and physical security measures to prevent unlawful processing of your personal data, unauthorized access, and to ensure their protection. In the event that personal data are obtained unlawfully by others, the situation will be promptly reported in writing to the Personal Data Protection Board in accordance with legal requirements.

Accuracy and Currency of Personal Data

Pursuant to Article 4 of the KVKK, our Company has the obligation to keep your personal data accurate and up-to-date. Therefore, customers must share accurate and up-to-date information or update their data via the website/mobile application to enable our Company to fulfill its legal obligations.

Rights of Personal Data Owners under Article 11 of KVKK

As of October 7, 2016, the rights of personal data owners are as follows:

  1. To learn whether personal data are being processed,

  2. To request information if personal data have been processed,

  3. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

  4. To know the third parties to whom personal data are transferred domestically or abroad,

  5. To request correction if personal data are incomplete or incorrectly processed,

  6. To request the deletion or destruction of personal data under the conditions set out in Article 7 of KVKK,

  7. To request notification of corrections, deletions, or destruction to third parties to whom personal data have been transferred,

  8. To object to results obtained against themselves by exclusively automated processing of data,

  9. To request compensation if they suffer damages due to unlawful processing of personal data.

A.Ş., registered under Antalya Chamber of Commerce and Industry [42195-44393], with MERSIS number [0817050886100001], located at [Kızıllı Mahallesi, Göncüler Sokak No: 11/1, Kepez - Antalya / TURKEY], is the Data Controller under KVKK. A Data Controller Representative appointed by our Company will be announced in the Data Controllers Registry and on this website once the legal infrastructure is established.
